    At SmoothSe, we take your privacy seriously. This Privacy Policy explains how we handle your data in compliance with Indian law, including the Digital Personal Data Protection Act, 2023 (DPDP Act), when you use our mobile and web applications ("Platform") and related services (collectively, the "Services").

    For this policy, it's important to understand the difference between the two main types of data we handle:

This includes, for example, your name, phone number, personal email, IP address, device ID, bank account numbers, and copies of personal government ID. The DPDP Act's strong rules for consent and rights apply specifically to this data.

    Business Data: This is information about your company that does not identify you as an individual. This includes your public business name, public business address, inventory levels, aggregated sales figures, business workflow details, and anonymous statistics we collect about your business operations.

    1. Your Agreement (Consent)

    By using the SmoothSe Platform or Services, you are giving us your permission to handle your data.

    1.1. Your Clear Agreement (Explicit Consent)
    By using SmoothSe, you confirm you've read and agree to how we collect and use your data, as described in this policy. This is your clear and informed consent (permission) for us to handle your information. If you don't agree, please do not use our Platform and Services.

    1.2. Why We Need Your Data (Notice)
    Before we collect any of your Personal Data, we will clearly tell you what kind of data we need and the reason we are collecting it. We will only use your data for those stated reasons.

    1.3. Changing Your Mind (Withdrawal)
    You can tell us to stop using your Personal Data (withdraw your consent) at any time. This won't affect any actions we took before you withdrew permission. Contact our Grievance Officer (see Section 12) to do this.

    1.4. Users Must Be 18 or Older
    Our Platform is designed for adults who are 18 years of age or older. We need the verifiable permission of a parent or guardian to handle the data of anyone under 18. If you are under 18, please do not use the Platform.

    1.5. Your Responsibility for Your Customers' Data
    If you collect, store, or use your customers' personal data (like their contact information) through our Platform, you are responsible for getting their permission and following the law (DPDP Act) regarding their data. You agree and undertake to indemnify us in any suit or dispute by any third party arising out of disclosure of information by you to third parties either through our SmoothSe Platform or otherwise and your use and misuse of information received through the SmoothSe Platform.

    2. What Information We Collect

    We collect different types of information to provide and improve our Services, including:

    Account Information (Personal Data): When you sign up, we collect personal details like your name, email address, and phone number.

    Business Information (Personal Data & Business Data): This includes details you give us about your business, such as the business name, address, business bank account details (used solely for your business profile and operational purposes), social media handles, and copies of government ID. It also includes any data you put into the Platform to manage your business (inventory, sales, customer details, etc.). We do not collect or store any payment credentials, credit/debit card details, or billing information for charging you for SmoothSe — our Platform is free to use.

    Usage Data (Personal Data & Business Data): Information about how you use the Services, such as which features you click on, the pages you visit, and your search history.

    Device Information (Personal Data): Details about the device you use to access SmoothSe, like the type of device, operating system, and IP address.

    3. How We Use Your Data

    We use the information we collect for these specific, legal reasons:

    To Run and Improve our Services: We use your data to help you manage your business (inventory, sales, etc.). We also use your aggregate, de-identified data (data that can't identify you or your business) to provide anonymous market insights to all SmoothSe users, as well as to improve the SmoothSe Services.

    Communication: To send you important information about the Services, updates, announcements, and special offers.

    Support: To answer your questions, handle your requests, and help you troubleshoot problems.

    Personalize Your Experience: To customize our Services and make them work best for your business.

    Research: To measure interest in our products, conduct market research, and analyze trends.

    Fraud Protection: To protect against fraud, unauthorized transactions, and other liabilities.

    Security and Legal Reasons: To protect us against criminal activity, enforce our terms, and comply with all legal requirements.

    4. Cookies and Tracking Technologies

    We use common tracking technologies (like cookies, web beacons or pixels) to track activity on our Platform and improve your experience. We use these for:

    Functionality: To make the Platform work correctly (e.g., keeping you logged in).

    The SmoothSe Platform may contain links to other websites or apps. If you click on those links, any information collected about you by those third-party sites is not covered by this Policy. We are not responsible for the privacy practices or content of any external website or app.

    7. What You Can Ask Us To Do With Your Data (Your Rights)

    As a user of SmoothSe, you have the following rights over your Personal Data under the DPDP Act:

    7.1. Right to Know (Access)
    You have the right to ask us for a summary of all the Personal Data we hold about you and how we've been using it.

    7.2. Right to Fix or Delete (Correction and Erasure)
    If your data is wrong or incomplete, you can ask us to correct it. You can also ask us to delete your Personal Data, unless we are legally required to keep it (see Section 8).

    7.3. Right to Complain (Grievance Redressal)
    If you have any issue or complaint about how we handle your data, you can contact our Grievance Officer (see Section 12) directly to resolve it.

    7.4. Right to Choose a Nominee
    You can choose a specific person (a nominee) who can exercise these data rights on your behalf if you pass away or are unable to manage your own affairs.

    7.5. How to Use Your Rights
    You can use these rights by contacting our Grievance Officer. We will respond to your request quickly and according to the law.

    8. Data Retention and Disposal

    We will only keep your Personal Data for as long as it is necessary to fulfill the specific purposes for which it was collected, or as required by Indian law (such as tax or accounting regulations).

    Active Accounts: We keep your data while your SmoothSe account is active.

    Inactive Accounts: If you close your account, we will delete or anonymize your Personal Data (turning it into Business Data) within a reasonable period, except for limited information we are legally required to retain for audit purposes (such as financial records).

    9. How We Keep Your Data Safe & What Happens If There's a Breach

    We use reasonable security measures and procedures to protect your Personal Data from being accessed, lost, or misused by anyone unauthorized. However, transmitting information over the internet is never 100% secure.

    Data Breach Notification: If our security is compromised and your Personal Data is affected, we will immediately inform you (the affected users) and take other steps as required by law.

    User Security Responsibility: If you suspect any unauthorized use of your account, you must immediately tell us by emailing info@smoothse.in. You agree and undertake to indemnify us for any loss suffered by us arising from any unauthorized use of your account or password.

    10. Data Storage Location and International Transfer

    SmoothSe primarily stores and processes your Personal Data within secure data centers in India.

    However, to ensure the reliable provision of services and backup, your Personal Data may be securely transferred, stored, and processed in countries outside of India, provided such transfers comply with the applicable legal standards under the DPDP Act. By using our services, you consent to this potential transfer.

    11. Policy Updates & Miscellaneous

    Policy Updates: We may update this Policy occasionally. Any changes will be posted immediately on this page. If you continue to use the SmoothSe Platform or Services after the changes are posted, you are agreeing to the new, updated Policy.

    Disclaimer: While we take utmost care to protect your privacy, we cannot guarantee that your information will always remain private. You agree that you assume all responsibility and risk for your use of the Services and the information you post or access.

    If One Part is Invalid (Severability): If any part of this Policy is found to be invalid or unenforceable, it will not affect the validity of the remaining parts of the Policy.
